The Need for Immigration Compliance

In a recent press conference in Myrtle Beach, Rep. Nancy Mace introduced the South Carolina Employer Immigration Compliance Act, a legislative proposal designed to crack down on businesses that hire illegal immigrants. The proposed law seeks to impose strict penalties on employers who knowingly employ undocumented workers, aiming to protect the rights of South Carolina workers and ensure fair competition in the job market.


Strengthening Enforcement Measures


Under the South Carolina Employer Immigration Compliance Act, employers who hire illegal immigrants would face a $1,000-per-day fine for each undocumented worker, with escalating penalties for repeat offenses. The legislation aims to reinforce the enforcement of the federal E-Verify system, which has been mandatory for all employers in South Carolina since 2012. By increasing fines and strengthening license suspensions, the proposed law aims to deter businesses from engaging in illegal employment practices and promote compliance with immigration laws.


Promoting Fair Competition and Protecting Workers

The South Carolina Employer Immigration Compliance Act also includes provisions to reclaim economic development incentives, tax credits, grants, and abatements from violators who hire illegal workers. Employers who fail to use E-Verify would be required to pay daily fines until compliance is achieved, and they would be banned from receiving state incentives for a period of five years. The act aims to create a level playing field for businesses that adhere to the law and protect the wages of South Carolina workers from being undercut by employers who flout immigration regulations.
